Conspiracy is defined as “an agreement of two or more people to do something that is unlawful.” It does not matter whether the plan was successful or not, or even whether any steps were taken to carry out the plan. In the simplest terms, you can be found guilty of conspiracy as soon as you agree with someone else to commit a certain crime.
The punishment depends on the crime the defendants conspired to commit:
- If the punishment for the underlying crime is 20 years to life in prison, the maximum punishment for conspiracy is 20 years;
- If the punishment for the underlying crime is 10 years to life in prison, the maximum punishment for conspiracy is 10 years;
- If the underlying crime is a felony punishable by less than 10 years in prison, the maximum punishment for conspiracy is 5 years;
- For all other crimes, the maximum punishment for conspiracy is 2½ years.
